Contractors are increasingly involved at an early stage on construction projects, under an ECI or pre-construction arrangement. Principals expect contractors to advise on aspects such as buildability, and other value opportunities. But in many situations, principals may also expect contractors to cover design issues by stealth. This presentation will explore what is meant by ‘buildability’, some of the obligations commonly included in ECI projects, how these relate to development of the design, and the scope of potential liability. Arie Moore is a specialist construction and projects lawyer and founded Reflective Construction Law in 2018. He advises clients on the development of projects as well as the resolution of disputes during construction. Arie has worked for clients across the industry, but has a particular focus on working for contractors and principals. Arie has regularly been involved in alternative procurement models such as design-and-build and early contractor involvement (ECI) contracts.
Sonia Ginders is a senior solicitor with Reflective Construction Law, and works with clients on construction related projects, from procurement of construction projects, to project claims and disputes.
